Carbon tax fine for fitness club

ACCC chairman Rod Sims

A FITNESS club that claimed the carbon price would drive up the price of its gym memberships has been fined $6600 by the Australian Competition and Consumer Commission.

Genesis Fitness Club in Berwick, Victoria, becomes the first business to be fined for making misleading claims about the impact of the controversial carbon tax, which came into effect on July 1.

The club sent a letter to more than 2000 of its members in April promoting a "rate freeze", offering its members a range of lengthy contract extensions at current or reduced membership rates.

The club told members that taking up the offer would help them avoid a 9-15% fee increase arising from the carbon tax.

It is believed more than 200 members took up the offer.

On top of the hefty fine, members who accepted the offer have been offered the opportunity to withdraw from the contract extension at no extra cost.

ACCC chairman Rod Sims said this was a good outcome who may have been misled by the health club's claims. Mr Sims said the gym did not have a "reasonable basis" for its claim.

"We are concerned that the false claims about the carbon price may have encouraged these people to sign lengthy contract extensions they otherwise would not have," Mr Sims said. "Businesses are free to set their prices as they see fit, but must carefully consider the basis for making carbon price claims and ensure such claims are truthful and have a reasonable basis."

Genesis Fitness Club operates more than 50 health clubs across Australia, including one in Coffs Harbour and Tweed Heads.

Fitness business moves, expands

HOOPESTON Main Street Fitness, 221 East Main St., Hoopeston, is relocating and expanding into Stebbins Furniture building on North Market Street.

The business closed its location July 25 and reopens today as Hoopeston Health and Fitness at 226 N. Market St., according to the announcement on its Facebook site.

"The new gym will include $8,000 in new equipment," said Kevin Jett, marketing director for Eliseo "Al" Zamora, owner. "It will be the premier fitness in health with more than triple his present space."

The hours will remain 5 a.m. to 9 p.m. Monday through Friday, with the tentative possibility of being open Saturday.

"We are a full-service fitness facility, Zamora said. "We offer cardio, strength training, kickboxing, personal training and group training classes.

In addition to the new location, Zamora wants to open another fitness center in the area.

"We are working on creating another Main Street Fitness in the neighboring town of Milford," Zamora said.

Zamora, originally from Chicago, worked as a wrestling and football coach, but was by trade a union roofer, as was his father. He has always been active in coaching, martial arts and sports. When he moved to Hoopeston, he wanted something to do that he loved. The fitness center filled his need to stay active as a physical trainer. The Main Street Fitness center opened in July 2009.

Fitness club first to get carbon tax fine

A FITNESS club has become the first Australian business to pay a fine for making a false claim about the carbon tax.

GFC Berwick, trading as Genesis Fitness Club, paid $6600 to the Australian Competition and Consumer Commission (ACCC) as penalty for sending a letter to its members in April promoting a "rate freeze" offer.

The fitness club said that by taking up the offer, members could avoid a fee increase of nine to 15 per cent because of the carbon price.

More than 200 members took up the offer and extended their contracts.

"This raised concerns for the ACCC as the representation enticed members to sign lengthy contract extensions on the basis of false claims about the impact of carbon pricing," ACCC chairman Rod Sims told a small-business conference in Melbourne on Wednesday.

"When approached, the fitness club could not provide any information that provided a reasonable basis for the claims made."

Mr Sims said the company's CEO had written to all affected members offering them the opportunity to withdraw from the contract extensions at no cost.

Assistant Treasurer David Bradbury told reporters in Sydney the case was a timely reminder to consumers and businesses.

"We are concerned to hear of any instances where false claims are being made in relation to the carbon price," he said.

"But we have strong confidence ... in the ACCC, in their capacities in pursuing these matters."

Incentive to lose weight must come from within

Published: 7/31/2012 10:50 PM | Last update: 7/31/2012 10:50 PM Annie's Mailbox Dear Annie: My parents and siblings often complain that they can't lose weight. However, they douse their food in salt and sauces, drink alcohol before bed, and have no qualms about pulling out the potato chips or chocolate candy. I used to be like them, but I've lost a great deal of weight and feel fantastic.

When my family complains about their weight, I suggest that they accompany me on my walks or eat the same foods I eat, but they decline. They tease me when I measure out portion sizes or choose healthier options for my meals. They congratulate me when they notice my continuing weight loss, but then they urge me to "slow down." What does this mean? Are they jealous of my success?

Dear Healthier: Nothing. You have discovered that losing weight is important for your health, but you didn't do it because someone told you to. Your relatives must be self-motivated. The most you can do is set a good example by modeling the type of behavior that will help them. When they are ready, they will take the next step. It's possible they are jealous, or they may be genuinely concerned that you have some type of eating disorder. But if your diet is healthy and well-balanced, you should continue to focus on your own good habits and do your best not to lecture them on theirs. If eating around them is too difficult, take your meals elsewhere.

Dear Annie: Throughout my life, whenever I've been in a mixed group of men and women, the men frequently talk over the women or interrupt them before they are finished. Now that we are over 60, the problem is worse, as many of our male friends are hard of hearing. Do you have any suggestions about how to get a word in edgewise or finish a sentence tactfully? - Pat

Dear Pat: We hate to say it, but some men are simply dismissive of women's conversation. If you are close friends, you should mention it, asking them to be more considerate and reminding them when they forget. Otherwise, there's not much you can do other than talk over them, ignore them or direct your conversation to a more amenable listener.

Dear Annie: Your response to "At a Loss," the grandmother who was afraid of losing her grandson, missed the point. You said to check grandparents' rights in her state, but that her best bet is to get back into her daughter-in-law's good graces. I think that is unrealistic.

As a trial lawyer and grandfather, I would have advised her to call a family lawyer. They also should be advised to document everything they have done, and continue to do, for their grandchild, as well as every occasion on which they are denied visitation. They need to understand that the grandson has the right to see loving grandparents, as well.

One consultation with the lawyer would suffice to tell them what their rights are. - Louisville, Ky.

Dear Louisville: True, but not so simple. In fact, recently, courts in several states have ruled that statutes providing for grandparent visitation violate either federal or local state constitutions. Plus, there are multiple requirements that must be met before visitation is granted, and if the parents are still married and neither wants the grandparents to see the child, visitation is tremendously difficult.

We appreciate your encouragement for "At a Loss" to seek legal redress, and we hope it helps. But we still believe her best chance is to reconcile with her daughter- in-law.

FDA Approves Qsymia Diet Drug, with Warnings About Side Effects

Posted by Eric ChaffinJuly 31, 2012 9:45 AM

Most of us know that our country is in the grips of an obesity epidemic. Doctor recommended diet and exercise programs have not controlled the problem, so pharmaceutical companies are hard at work coming up with other solutions. Last month, the FDA approved Belviq (lorcaserin) as a weight-loss drug for those with a body mass index (BMI) of 30 or greater. More recently, the FDA approved Qsymia (phentermine and topiramate extended-release) for chronic weight management in addition to a reduced-calorie diet and exercise.

These drugs come with potentially serious side effects, and it seems like once again the public is taking part in a giant experiment. For example, federal officials are requiring post-marketing studies to look for evidence of increased heart disease or stroke risk in those who take Qsymia.

Concerns About Cardiovascular Risks

It was only about a year-and-a-half ago that the FDA rejected manufacturer Vivus first petition to approve Qsymia (pronounced kyoo sim EE uh). Among other things, the agency was concerned that the drug could increase the risk of heart attack and stroke. The FDA rejected Belviq in an earlier request for approval because of similar concerns.

Experts believe the agency has changed their position because of new data presented by the manufacturers, but also because of the ever-increasing health dangers associated with obesity. According to the Centers for Disease Control and Prevention, more than one-third of U.S. adults are obese, which can lead to heart disease, stroke, type 2 diabetes, and certain types of cancer.

In pre-approval studies, patients taking Qsymia who also made lifestyle changes lost an average of about 10 percent of their body weight after one year. Studies showed no evidence of increased cardiovascular risks. Critics note, however, that a similar drug, Fen-Phen, combined phentermine (an appetite suppressant) with fenfluramine, and was later taken off the market because of links to heart valve problems.

Concerns About Birth Defects

This time, the drug combines phentermine with topiramate, also known as Topamax, a drug currently prescribed to help control epileptic seizures and migraine headaches. In early 2011, the FDA warned that taking Topamax during pregnancy increases the risk of oral cleft birth defects such as cleft lip and palate. An analysis of the data shows that the risk is up to 16 times higher among women who take the drug than those who do not.

Many feel the warning came late, particularly women who took the drug in years past without the knowledge of the risks and gave birth to babies with birth defects. Hundreds of Topamax lawsuits were filed before awareness increased on the issue, but now the FDA has changed the classification from category C to category D risk, reflecting human data that confirms the fetal risk.
